NOTICE OF PASSING ZONING BY‑LAW NO. 1973-26
TAKE NOTICE That the Council of the Corporation of the Town of Rainy River passed By‑law No. 1973-26 on the 11th day of May, 2026, under Section 34 of the Planning Act, 1990, as amended.
By-law No.1973-26 reduces the minimum floor area of single detached dwellings and introduces land lease community homes, all with a minimum floor area of 18.6 square metres (200 square feet) per dwelling. Public consultation on the proposed Zoning By-law Amendment occurred through one statutory Public Meeting held on March 2 and a follow-up explanatory meeting on April 13, 2026. Notice of the statutory Public Meeting was published on the Town’s website on February 3rd, 2026. The Town received one comment on the proposed amendment which was resolved during the follow-up explanatory meeting.
AND TAKE NOTICE That an appeal to the Ontario Land Tribunal (OLT) with respect to all or part of this Zoning By-law Amendment may be made by filing a notice of appeal with the Clerk either via the Ontario Land Tribunal e-file service or by mail to 201 Atwood Avenue, Ontario, P0W 1L0 no later that 4:30 p.m. on the 14th of June, 2026. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day the 14th of June, 2026. The appeal fee of $1,100 can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the OLT and request a fee reduction for an appeal, forms are available from the OLT website at olt.gov.on.ca. If the e-file portal is down, you can submit such an appeal to [email protected]. Any such appeal must be accompanied by a certified cheque/money order in the amount of $700.00 made payable to the Corporation of the Town of Rainy River.
Only the applicant, a specified person or a public body, as defined in Section 1(1) of the Planning Act, plus registered owners of lands to which the by-law applies and who made submissions at the statutory Public Meeting, or who have made written submissions to the Town before the by-law was passed, are eligible to appeal the decision of the Town of Rainy River to the Ontario Land Tribunal.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
