NOTICE OF INTENT TO ADD ADDITIONAL RESIDENTIAL UNITS (ARU) PROVISIONS TO THE ZONING BY-LAW

The Council of the Corporation of the Town of Rainy River is initiating an amendment to the Rainy River Zoning By-law No.1614-15, as amended, to add provisions permitting Additional Residential Units (ARU) to mirror the same information which has been added to both the Planning Act and the Ontario Regulations.


TAKE NOTICE:       That the Council of the Corporation of the Town of Rainy River will consider at their regular meeting on June 9th , 2025 a proposed Zoning By‑law Amendment under Sections 34(19.1) and 35.1(3) of the Planning Act to amend By‑law No. 1614-15 as amended, the Rainy River Zoning By‑law. Council is not required to hear representations from the public on this matter.

LANDS AFFECTED:           This By-law applies only to suitable lots and residential units within the Residential R1, R1H and Residential Multiple R2 Zones and the Rural Ru Zone in the Town of Rainy River. This By-law does not apply to any lands zoned Flood Plain FP, Environmental Protection EP or to any residential unit  accessory to any use within the General Commercial GC or Highway Commercial HC Zones.

 

PURPOSE AND EFFECT:              The purpose of this By-law is to simply enable Rainy River Council, Staff and Ratepayers a direct reference to the provincial requirements for Additional Residential Units under the Planning Act with no need to consult the Act or the Regulations for identical information.

NOTICE OF PASSAGE

Decision:

On April 14th 2025, the Council of the Town of Rainy River, as the approval authority, made a decision to pass Zoning By-Law Amendment 1920-25, being a by-law to add provisions to the Town of Rainy River Zoning By-law 1614-15 to address Canada Bill C-45: An Act Respecting Cannabis (marijuana). It is the intent of the Zoning By-law Amendment to prohibit production of cannabis anywhere in Rainy River except by Zoning By-law Amendment.

Motion 25-051

“That By-law 1920-25, being a by-law to establish Cannabis Production Facilities and Retail Sales Zoning Amendment for the Town of Rainy River, having been read in open council, be hereby approved.”

Who May Appeal:
